Hedland Fencing

These Terms and Conditions constitute a legally binding agreement between Hedland Fencing and

the Client for the provision of our services. By accepting our quotation, the Client agrees to abide by

these Terms and Conditions. Please read these Terms carefully before proceeding.

1. Scope of Services

We will provide services as described in the proposal or work order provided to the Client. Any

changes or additional services must be agreed upon in writing.

2. Quotations and Estimates

We provide detailed quotations outlining the scope of work, materials required, and estimated cost

based on the information available at the time of assessment. Quotations are valid for a period of 14

days from the date of issue, unless stated otherwise. The final price may vary due to unforeseen

circumstances, changes in scope, or additional work requested. Any such changes will be discussed

and agreed upon before proceeding.

3. Payment

a. An upfront deposit may be required before work commences, as specified in the quotation.

b. The remaining balance is due upon completion of the services. Payment can be made by

electronic bank transfer or cash.

c. Invoices not paid within 14 days from the completion of service will incur a $50 late fee and 15%

interest charges per annum.4. Access to Property

The Client agrees to provide our personnel with safe and unhindered access to the property during

the agreed time and date. It is the Client’s responsibility to ensure the property is accessible and

secure during the service period.

a. If our personnel cannot access the property at the scheduled appointment, a $100 no-show fee

will be charged.

5. Cancellation and Rescheduling

a. Cancellations or rescheduling must be communicated at least 24 hours prior to the scheduled

appointment. Failure to do so may result in a $100 cancellation fee.

b. Hedland Fencing reserves the right to reschedule or cancel services due to unforeseen

circumstances, including but not limited to weather conditions or personal unavailability.

6. Delays

While we strive to complete projects within the agreed timeframe, delays may occur due to factors

beyond our control, such as material shortages or unforeseen issues. We will communicate any

significant delays and work to minimize their impact.

7. Materials

We may provide materials and products necessary for the work. These materials are subject to

availability and may be sourced from reputable suppliers. Any additional materials requested by the

Client during the project will be discussed and agreed upon, and their costs will be added to the final

invoice.

8. WarrantiesWe warrant that our services will be performed in a professional and workmanlike manner. Unless

explicitly stated otherwise in writing, no additional warranties are provided. Any manufacturer

warranties applicable to materials used will be passed on to the Client.

9. Liability

While we take all reasonable care during our services, we cannot be held liable for any property

damage, injury, or losses resulting from our work unless caused by our proven negligence. Clients

are encouraged to secure and protect any valuable or sensitive items prior to the commencement of

work.

10. Indemnification

The Client agrees to indemnify and hold Hedland Fencing harmless from any claims, damages, or

liabilities arising from the use of our services or any breach of this Agreement by the Client.

11. Insurance

We maintain appropriate liability insurance to cover potential risks associated with our services.

12. Termination

Either party may terminate this Agreement with written notice if the other party breaches any

material provision. Upon termination, the Client shall pay for all services performed and materials

provided up to the date of termination.

13. Communication

Both parties agree to maintain clear and timely communication and provide all necessary and

accurate information to ensure the smooth progression of the project.14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of

Western Australia.

15. Compliance with Local Regulations

Hedland Fencing strongly advises all clients to follow the regulations and guidelines of the Town of

Port Hedland. By accepting our quotation and these Terms and Conditions, the Client acknowledges

their responsibility to comply with these regulations. Should the Client choose not to follow the Town

of Port Hedland’s requirements, Hedland Fencing will not be held liable for any resulting actions,

penalties, or consequences imposed by the Town of Port Hedland or any relevant authority.

16. Client Responsibilities

The Client is responsible for:

a. Obtaining all necessary permits, approvals, or consents from local authorities unless otherwise

agreed in writing.

b. Ensuring all boundaries are correctly identified. Hedland Fencing is not responsible for installing

fences on incorrect boundaries if the Client provides incorrect or incomplete information.

c. Notifying neighbors if required and resolving any boundary disputes. We do not take responsibility

for neighbor disagreements, property line conflicts, or local council compliance issues unless

explicitly engaged to manage these matters.

17. Underground and Hidden Services

It is the Client’s responsibility to inform Hedland Fencing of the location of any underground services

(e.g. water pipes, gas lines, electrical cables). While we take reasonable care, we accept no liability

for damage to hidden or unmarked services unless caused by our negligence and clear

documentation was provided beforehand.18. Subsurface and Site Conditions

If unexpected site conditions (such as rock, tree roots, excess rubble, or buried waste) are

discovered, additional costs may apply. Work may be paused until the issue is resolved or the Client

agrees to revised terms.

19. Workmanship Exclusions

Hedland Fencing’s workmanship warranty does not cover:

a. Natural wear and tear, acts of God, storm damage, misuse, vandalism, or damage caused by

third parties.

b. Movement or shifting of soil or ground beneath fencing posts or footings.

c. Fading, rust, or corrosion resulting from weather exposure unless otherwise stated in product

warranty.

20. Photographic Use and Social Media

Hedland Fencing may take before-and-after photos of completed works for portfolio and promotional

purposes, including social media and website use. Clients who do not consent must notify us in

writing prior to the start of work.

21. Unattended Worksites

Hedland Fencing may leave materials or tools at the job site between workdays. Clients agree to

ensure the security of the site and understand we are not liable for loss, theft, or damage of

equipment due to third-party interference or unsecured areas.

22. Amendments

Hedland Fencing reserves the right to modify these Terms and Conditions at any time. The updatedTerms will be effective immediately upon being made available to the Client.

By accepting our quotation, the Client acknowledges that they have read, understood, and agreed to

these Terms and Conditions.
